Welcome to www.inthezoneyoga.co.uk, creating a comfortable space for children, teens and parents to get curious and discover more about their mind and body connection. As they get to understand how their body works, they learn how to bring their A game everyday and feel more at ease, and powerful in body and mind.

1.1 What any User should know at a glance

Our ‘In the Zone Yoga’ website is just for adults, while our content is designed for the whole family including children with appropriate parental awareness and supervision. Children, if you are under the age of eighteen (18), please ask a parent or guardian to explain their meaning to you. Your parent or guardian must read and accept these terms of use on your behalf and take full responsibility for compliance with these terms of use for you to access our website and participate in our classes and sessions. If you or your parent or guardian do not wish to be bound by these terms of use, please exit the website and do not access or use our website or services.

 

Below are our rules and regulations if you want to use our website and the services or products available from our website, and our in person events. If you do not agree to these rules, you cannot use our website or attend our in person events. 

 

We can change these rules whenever we want and will post the new rules on our website, and you may or may not notice changes.  We have intentionally written them in a way that avoids excessive ‘legal language’ so that everyone can clearly understand and agree to the rules and understand their rights and responsibilities.  

 

We hope there won’t be any problems and that you will reach out to us if you are having issues with our site, service, or products.

 

www.inthezoneyoga.co.uk is a website owned and operated by Naughty Elephants Limited, a private company incorporated and registered in England and Wales with company number 09119485 whose registered office is at Compass Court, 148 Bearwood Rd, Wokingham, Berkshire, England, RG41 4SN. These terms of use apply to all use of the website and form a legal agreement between you and In the Zone Yoga. Please read them carefully.

2. Services

We offer both in-person ‘Event’ Sessions and online Hatha style yoga class ‘Event’ Sessions and guided meditation/relaxation sessions for children and adults. Our services include:

• Yoga classes both for groups and 1:1 private sessions

• Guided meditation/relaxation sessions

• Workshops and mini-retreats

These terms and conditions relate to your attendance at In the Zone Yoga Classes and Courses (“Event”) and/or participation in any of the yoga movement, breath work and relaxation sessions.(“Sessions”). By attending the Event and/or participating in one of the Sessions you agree to abide by the following terms and conditions and any additional terms and conditions as may be communicated to you from time to time.

 

2.1 The Event is owned by In the Zone Yoga, a subsidiary of Naught Elephants Ltd  (“In the Zone Yoga”) is responsible for the organisation of the event and hiring the location, as well as managing any communication around the event.

2.2 The in person Event is a yoga event aimed at all abilities. The Adult Sessions each last approximately 30 minutes to 1 hour, and the Children Sessions last 30 mins, with a warm up, a cool down and guided relaxation. Nicole will welcome you to the event and aims to create a comfortable and calm environment for your benefit. 

2.3 Participants at an Event or Sessions under 18 years of age must have adult approval before participating.

2.4 You must act responsibly and sensibly at all times, follow all instructions concerning the Event and Sessions, and adhere to all of the health and safety procedures outlined at the Event. If you do not you may be required to leave the Event Session, and any fees due will be non refundable.

2.5 You confirm that you understand that participation in the Event involves physical exercise and that you should only participate at an intensity which is appropriate to your level of fitness and flexibility. ‘In the Zone Yoga’ can not entirely eliminate the risks of you participating in the Event including the risk of physical injury. You are responsible for monitoring your own physical condition (and that of any children you are responsible for) before, during and after the Event Session. You acknowledge the risks inherent in taking part in the Event including any injury which may be sustained or any illness which may be worsened by taking part in physical exercise.

2.6 You must not participate if you are under the influence of alcohol or non-prescription drugs.

2.7  In the absence of any negligence or other breach of duty by In the Zone Yoga, participation in the Event is entirely at your risk.

2.8 In the Zone Yoga may remove from the Event any persons it deems to be acting inappropriately; cancel or change the location, time or date of any Event at its absolute discretion and at the discretion of the schools we are working with.

2.9 You understand that photographs, videos, sound recordings and other accounts or descriptions (whether data, textual, visual or audio) may be taken at the Event which may feature you or your children. You acknowledge that In the Zone Yoga may wish to use the data featuring you and, if applicable your children. We will always ask your permission to use any photos or other media featuring your children; for the purposes of In the Zone Yoga printed publications, presentations, promotional materials, in the advertising of In the Zone Yoga’s goods or services.

2.10 In the Zone Yoga will use your personal data for the necessary purpose of administering the Event. Please see our Privacy Policy for further details.

3. Booking and Payment

• When the User submits an order or booking, Users will receive a thank you confirming that the order has been received.

• All notifications related to the purchasing process shall be sent to the email address provided by the User for such purposes. 

• Prices for In the Zone Yoga Adult 'Zen Zone' and Children's 'Play Zone and Teens 'Sport Zone' group in person classes are displayed clearly, and can be booked directly, on our website.   

• Tickets for Events and the cost per student per Session will be clearly communicated to the individuals, school or local youth clubs and agreed upfront to meet the needs and the bespoke requirements discussed.

• All In the Zone Yoga Online Courses prices are clearly displayed upfront on our website.  

• All bookings must be made through our website or directly with Nicole McDonnell.

• In consideration of you participating in one or more of the Sessions you agree to pay the relevant ticketing fee(s) per Session, for the number of weeks of the course duration, to In the Zone Yoga, or  the ‘Playtime Yoga’ brand for children under 8 yrs; via booking on our website or via an invoice sent to the school or club directly, payable 2 weeks upon receipt.  

• Payment is required at the time of booking for private block bookings, or on the day of Session for 1:1 PAYG. 

• We invoice schools at the start of the termly (or shorter) courses, once the course commences.

• Methods of payment.  Information related to accepted payment methods is made available during the purchasing process.  We accept bank transfers and online payment on our website.  All payments are independently processed through third-party services. Therefore, In the Zone Yoga does not collect any payment information – such as credit card details – but only receives a notification once the payment has been successfully completed. The User may read the privacy policy of In the Zone Yoga to learn more about the data processing and Users’ rights regarding their data.  If a payment through the available methods fails or is refused by the payment service provider, the Owner shall be under no obligation to fulfil the order. If a payment fails or is refused, the Owner reserves the right to claim any related expenses or damages from the User.

• Offers and discounts: The Owner may offer discounts or provide special offers for the purchase of Products. Any such offer or discount shall always be subject to the eligibility criteria and the terms and conditions set out in the relevant section of In the Zone Yoga website.  Offers and discounts are always granted at the Owner’s sole discretion. Repeated or recurring offers or discounts create no claim/title or right that Users may enforce in the future.  Depending on the case, discounts or offers shall be valid for a limited time only or while stocks last. If an offer or discount is limited by time, the time indications refer to the time zone of the Owner, as indicated in the Owner’s location details in this document, unless otherwise specified.

4. Cancellations, Refunds & Payment Collection

• We like to have fun, and we take our business seriously.  We’d appreciate your careful consideration when making bookings and that you kindly adhere to our payment and cancellation policies.

• If we cancel a session, a full refund will be provided.

• Nicole McDonnell reserves the right to charge 1.5% interest per day upon any outstanding sum left unpaid on or after 14 calendar days from due date.  After 30 days of outstanding payment, Nicole McDonnell reserves the right to send you to collections, upon which you will owe the total amount of any outstanding payments plus any collection costs.

5. Health and Safety

• Participants must ensure they are in good health before attending any session.

• It is the participant's responsibility to inform the instructor of any medical conditions or injuries at the start of the session.

• By participating in our products and services you agree to take responsibility for your own health and agree to notify Nicole McDonnell in advance, about any possible constraints or factors that may affect the degree to which you are able to participate in yoga classes.

• In the Zone Yoga (including Nicole McDonnell and other partner yoga or wellbeing instructors) are first aid trained, they are not medically trained and cannot provide medical advice or diagnosis. They are not qualified to express an opinion that you are fit to safely participate. You must obtain professional or specialist advice from your doctor before participating.

• Nothing on the site, or offered through its services or products, is intended to diagnose or treat any physical or mental illness. No information on the site is intended to be legal or medical advice and is for educational purposes only, unless clearly marked otherwise.

Sometimes mistakes happen, even when we try to find reliable vendors to help us operate our site and its services.  We will always work towards fixing things in a timely way, and thank you for your patience.

• Any testimonials reflect the accurate experience of the person quoted, however, your results with any particular product or service may vary. 

• This site may use advertising or affiliate links to sell certain products or services. We disclaim any and all liability as a result of your purchase through one of these links. We will use reasonable efforts to notify you when and where we have placed ads or affiliate links in addition to this disclaimer located in these Terms & Conditions.
